The Office of Counsel to the Inspector General (OCIG), Office of Inspector General (OIG), U.S. Department of Health & Human Services (HHS), is seeking experienced attorneys in the following areas:

Administrative & Civil
Remedies Branch

   

Enforcement attorney

Health care fraud attorney with three or more years’ experience to represent the Office of Inspector General in the investigation, litigation, and settlement of civil and administrative actions involving false claims, kickbacks, patient dumping, sub-standard quality of care, and other offenses.

Candidates should have experience in one or more of the following areas: criminal, civil, or administrative litigation; Federal health care program reimbursement; or the development of corporate health care compliance programs and/or the negotiation of OIG corporate integrity agreements. In addition, candidates will be evaluated based upon their knowledge and experience with respect to OIG administrative sanctions (i.e., civil monetary penalties and exclusions), the Anti-kickback Statute, the Stark Law, and the civil False Claims Act. Candidates should possess strong writing, advocacy, and negotiation skills. OIG encourages candidates with degrees in health care or health law or who participated in a health law program to apply. Position is at the GS-13/14 level, depending upon experience.

Advice Branch

   

Advice attorneys

Advice attorneys to provide legal counsel and representation to the Office of Inspector General, HHS, on a broad array of issues, including: personnel law and employment discrimination; advice to OIG on the operation of HHS programs (including Medicare, Medicaid, public health programs such as NIH research grants, and public welfare programs such as foster care, child support enforcement and head start); the scope and exercise of the Inspector General’s authorities and responsibilities; investigative techniques and procedures (including criminal procedure); information disclosure and privacy; the audit process; issuance and enforcement of Federal subpoenas; ethics and budget and appropriations.

Personnel
law/employment
discrimination

Attorneys to provide legal counsel and representation to the Office of Inspector General, HHS, primarily in the area of Federal personnel law and employment discrimination. The attorney will also be responsible for providing legal advice relating to internal investigations of Department employees. The attorney will have the opportunity to provide advice and representation on an array of unique legal issues that arise in the representation of a Federal enforcement agency. In carrying out these responsibilities, the attorney will provide day-to-day legal advice to managers in the investigative, auditing and evaluation fields, and to criminal investigators conducting internal investigations. The position also offers the opportunity to handle administrative litigation in a variety of forums.

Oversight of HHS
programs

Attorneys to provide legal services to OIG audit and inspection components in exercise of OIG’s program oversight responsibilities under the Inspector General Act. Attorneys will provide advice and prepare opinions on a wide array of legal issues relating to programs and operations of HHS. Candidates should have knowledge of either: (a) legal requirements of HHS programs; or (b) Inspector General Act and audit and inspection process.

Industry Guidance
Branch

   

 

Experienced health care attorney to prepare advisory opinions, bulletins, regulations, and compliance guidance that address the legality of cutting edge health care transactions and arrangements under the anti-kickback statute and other Federal fraud and abuse laws. Ideal candidates will have experience in one or more of the following areas: health care fraud and abuse laws, particularly the anti-kickback statute and “Stark” law; complex health care business transactions; the Medicare program; the Medicaid program; and complex regulatory schemes for business arrangements. Knowledge and experience in the litigation of criminal, civil, or administrative cases, including OIG administrative sanctions (i.e., civil monetary penalties and exclusions) will also be considered. The position requires excellent written and oral communication skills. The attorney’s duties would include:

  • Review and analysis of advisory opinion requests and the drafting of advisory opinions.
  • Drafting safe harbor regulations, compliance guidance, fraud alerts, and special advisory bulletins.
  • Review of Department regulations related to the Medicare and Medicaid programs.
  • Development and promotion of OIG policies and guidance regarding the anti-kickback statute.
  • Advising OIG staff and other government officials on the application of the fraud and abuse laws.
  • Responding to questions and issues from industry representatives regarding compliance with the Federal fraud and abuse laws.

The attorney may also be called upon to perform other duties, including assisting with the investigation and litigation of cases involving allegations of false claims, kickbacks, and Stark law violations.
